Addendum E – OneCard

NFC Business Card Service

This Addendum is incorporated into and governed by the Gaviso Terms of Use and Service Agreement.

This Addendum governs the use and provision of OneCard, a near-field communication (NFC) business card product offered by Gaviso Digital Marketing, LLC (“Gaviso”). OneCard is a physical, tap-enabled card linked to a hosted mini-profile page that may display your contact information, links, and brand assets. This Addendum is hereby incorporated into the Master Terms of Use and Service Agreement.

1. Description of Service

1.1 Product Overview. OneCard is a printed plastic NFC-enabled card designed to link users to a mobile-friendly mini-profile page hosted by Gaviso. The service includes:

  • One (1) NFC card per order
  • A unique URL linked to a hosted landing page (“profile page”)
  • Basic customization of profile layout and branding

1.2 No Digital Wallet Integration. OneCard does not include Apple Wallet, Google Wallet, or other digital pass features. This distinguishes it from Gaviso’s GavisoOne membership, which does include Apple Wallet-based functionality.

1.3 Customization. Cardholders may customize profile page content (name, title, contact info, social/media links, profile image). Custom design and layout enhancements may be offered as paid upgrades.

 

2. Use and Limitations

2.1 Business Use Only. OneCard is intended for professional identification, business networking, or brand promotion. You agree not to use the card or hosted page for illegal, defamatory, or deceptive purposes.

2.2 NFC Compatibility. Tap-to-view functionality depends on device compatibility and reader availability. Gaviso makes no guarantee of functionality across all smartphones or operating systems.

2.3 Reprint Limitations. If your information changes after production, a new card must be ordered. Physical cards cannot be reprogrammed after printing.

 

3. Delivery and Ownership

3.1 Production and Shipping. Production time typically ranges from 7–10 business days from order confirmation. Delivery times vary by location. Gaviso is not liable for delays caused by shipping carriers or address errors.

3.2 Lost or Damaged Cards. Replacement cards may be ordered at cost. Gaviso is not responsible for loss, theft, or damage once the card is delivered.

3.3 Intellectual Property. All design templates, icons, and layout frameworks used in the hosted mini-profile remain the property of Gaviso. Clients may not reproduce or redistribute proprietary assets without prior written permission.

 

4. Profile Hosting and Content

4.1 Hosting. Each card includes a hosted mini-profile page as part of the service. Gaviso reserves the right to suspend hosting if the page contains:

  • Inaccurate, misleading, or unauthorized claims
  • Obscene, defamatory, or infringing content
  • Links to malware or prohibited services

4.2 Editing Access. Clients may submit updates to profile content through Gaviso’s designated interface or request portal. Update turnaround may vary depending on support volume.

4.3 Link Retention. The hosted profile link will remain active for at least one (1) year from the date of issuance. Continued hosting beyond one year may require renewal or subscription.

 

5. Refund and Cancellation Policy

5.1 Refund Eligibility. Due to the custom nature of physical production, OneCard orders are non-refundable once printing has begun.

5.2 Error Handling. If Gaviso is at fault for production errors (e.g. misprints, wrong URL), a corrected card will be reissued at no cost.

5.3 Grace Period Exception. If cancellation occurs within seven (7) days of order and prior to printing, a full refund may be issued upon written request.

 

6. Disclaimers and Limitations

6.1 No Guarantee of Connection. Tap-based interactions rely on hardware compatibility and external conditions. Gaviso is not responsible for connection failures due to external interference or user settings.

6.2 As-Is Basis. OneCard and associated profile hosting are provided “as is.” Gaviso makes no warranty regarding the uptime, display consistency, or mobile responsiveness of hosted pages across all devices.

6.3 Limitation of Liability. To the maximum extent permitted by law, Gaviso’s liability is limited to the amount paid for the card and hosting in the twelve (12) months preceding the claim. Gaviso is not liable for indirect or consequential damages arising from the use or failure of the card or hosted page.
