Terms of Use and Service Agreement

This Addendum is incorporated into and governed by the Gaviso Terms of Use and Service Agreement.

This Addendum governs the use of GavisoOne, a membership-based digital business card and benefits platform operated by Gaviso Digital Marketing, LLC (“Gaviso”). GavisoOne provides members with a digital Apple Wallet pass, access to exclusive benefits, and a personalized mobile-friendly mini page for professional promotion. This Addendum is hereby incorporated into the Master Terms of Use and Service Agreement.

1. Description of Service

1.1 Platform Overview. GavisoOne is a digital membership service that includes:

• An Apple Wallet-compatible digital pass customized with member information
• A personalized bio/profile mini page linked to the pass
• Access to member-only perks and discounts
• Administrative access for limited content customization

1.2 No Physical NFC Card Included. GavisoOne does not include a plastic NFC-enabled card. The service is distinct from OneCard and is intended for fully digital use.

1.3 Membership Term. Membership is valid for one (1) year from the date of purchase unless otherwise stated. Membership may be renewed annually.

 

2. Membership Features

2.1 Wallet Pass Functionality. The digital pass can be added to Apple Wallet and, where supported, Google Wallet. It includes scannable QR functionality and links to the member’s mini-profile page.

2.2 Mini Page Features. The hosted page includes name, title, business name, contact links, image, and customizable buttons or sections (subject to platform limitations). Premium layout options may be offered at additional cost.

2.3 Perks and Benefits. Membership includes access to:

• Exclusive discounts from Gaviso partners (e.g. Herman Miller, Surfshark VPN)
• A listing in the public Frisber.co directory
• Free or discounted services offered by Gaviso, such as branded digital materials or course access via Gaviso Academy
• Additional benefits may be modified or discontinued at Gaviso’s discretion with or without prior notice.

 

3. Use Restrictions and Member Responsibilities

3.1 Professional Use Only. GavisoOne is intended for use by business professionals and service providers. Members may not use the pass or linked page for personal solicitation, illegal activity, or deceptive marketing.

3.2 Content Standards. You are responsible for the accuracy of all content submitted for the pass and mini page. You agree not to include:

• Misleading professional claims
• Inappropriate language or images
• Links to malware, adult content, or illegal services

3.3 Compliance with Law. Use of the Wallet pass and digital platform must comply with all applicable privacy, advertising, and consumer protection laws in the U.S. and Canada.

 

4. Cancellations and Refunds

4.1 Grace Period. You may cancel your membership for a full refund within seven (7) days of purchase, provided that the Wallet pass has not been generated and issued.

4.2 Non-Refundable After Activation. Once the Wallet pass has been generated, the membership is non-refundable, including unused time or partially used benefits.

4.3 Benefit Adjustments. Discounts and third-party perks are not guaranteed and may be withdrawn at any time. No refunds will be provided based on changes to external benefits.

 

5. Hosting and Availability

5.1 Pass Hosting. GavisoOne passes are hosted and maintained by Gaviso or a designated third-party provider. Interruption of access due to maintenance, system upgrades, or third-party infrastructure issues does not entitle members to refunds.

5.2 Mini Page Hosting. Your mini page remains hosted for the duration of your membership. If membership lapses without renewal, the mini page may be archived or removed after 30 days.

5.3 Data Retention. Data submitted for Wallet pass creation and mini page setup will be retained only for the duration of the active membership term, unless otherwise required by law.

 

6. Disclaimers and Limitation of Liability

6.1 As-Is Basis. GavisoOne and associated benefits are provided “as is.” Gaviso does not guarantee uptime, device compatibility, or the continued availability of third-party offers.

6.2 Limitation of Liability. To the maximum extent permitted by law, Gaviso’s liability is limited to the membership fee paid in the preceding twelve (12) months. Gaviso is not liable for indirect or consequential damages arising from the use or unavailability of Wallet passes or benefits.

6.3 Indemnification. You agree to indemnify and hold harmless Gaviso for any claims, damages, or liabilities arising from your misuse of the platform or violation of this Addendum.
