Terms of Use and Service Agreement

This Addendum is incorporated into and governed by the Gaviso Terms of Use and Service Agreement.

This Addendum governs the use of Frisber, a public-facing professional directory and business discovery platform operated by Gaviso Digital Marketing, LLC (“Gaviso”). Frisber is designed to help professionals and service providers promote their offerings through listings, profile pages, and directory placements. This Addendum is hereby incorporated into the Master Terms of Use and Service Agreement.

1. Service Description

1.1 Platform Overview. Frisber enables individuals and businesses to create and publish public profiles (“Listings”) that may include:

• Name, title, service category, and contact information
• Website or booking links
• Testimonials, credentials, and portfolio items (where applicable)
• A customizable bio and professional summary

1.2 Listing Visibility. All listings submitted to Frisber are considered public and may be indexed by search engines unless otherwise stated. Featured listings may be prioritized based on platform plan or editorial discretion.

1.3 Editorial Discretion. Gaviso reserves the right to approve, reject, modify, or remove listings at its sole discretion for quality control, compliance, or editorial alignment.

 

2. Use Eligibility and Client Responsibilities

2.1 Eligibility. Frisber is intended for professionals, entrepreneurs, and small businesses offering legal, ethical, and verifiable services. Listings for prohibited services (see Section 4) or anonymous, unverifiable profiles will be rejected.

2.2 Accuracy and Updates. You agree to maintain the accuracy of your listing and promptly update it when changes occur. You must not impersonate another person or organization, submit misleading qualifications, or publish deceptive content.

2.3 One Listing Per Business Entity. Multiple listings for the same business, person, or service offering may be removed unless they represent distinct service lines or geographic locations, as determined by Gaviso.

 

3. Plans and Payments

3.1 Free and Paid Listings. Frisber offers both free and paid plans. Paid plans may include:

• Featured placement or search prioritization
• Enhanced profile design
• Access to performance analytics or lead activity
• Priority support and platform perks

3.2 Upgrades and Downgrades. You may upgrade or downgrade your plan at any time. Downgrades may result in loss of visibility or features. No retroactive refunds are issued for unused time when downgrading.

3.3 Cancellation. You may cancel your plan at any time. Listings will remain active until the end of the billing period unless you request immediate removal. No prorated refunds are issued after the 7-day grace period.

 

4. Prohibited Services and Content

4.1 Prohibited Listings. Frisber may not be used to list or promote:

• Adult services or sexually explicit content
• Multi-level marketing (MLM), pyramid schemes, or get-rich-quick programs
• Products or services that are illegal in the U.S. or Canada
• False medical claims, unlicensed therapy, or unproven financial services
• Services that promote hate speech, harassment, or defamation
• Lead generation, data brokerage, or scraping businesses

4.2 AI-Generated Content. Gaviso reserves the right to flag or remove AI-generated content that is misleading, low-quality, or not properly disclosed.

4.3 User Reporting. Users may report listings believed to violate these terms. Gaviso will investigate and, if necessary, take action without prior notice to the listed party.

 

5. Lead Activity and Contact Form Submissions

5.1 Lead Access. If your listing includes a contact form or lead capture mechanism, submitted data will be accessible through the platform or forwarded to your registered email address. You are responsible for responding to inquiries in a timely and professional manner.

5.2 Attribution and Analytics. Frisber may track and provide insights into profile traffic, impressions, and contact form activity. You agree that such analytics are owned by Gaviso and provided as a courtesy, not a guaranteed feature.

5.3 No Data Export Guarantees. Upon termination or downgrade, you may lose access to past lead data. It is your responsibility to export or save data prior to account changes.

 

6. Disclaimers and Limitation of Liability

6.1 No Endorsement. Frisber is a listing platform, not a verification or endorsement service. Gaviso does not certify the credentials, quality, or legitimacy of any user or business listed on the platform.

6.2 As-Is Basis. The platform is provided “as is” and “as available.” Gaviso makes no guarantee of listing visibility, ranking, or lead volume.

6.3 Limitation of Liability. To the extent permitted by law, Gaviso’s total liability for claims arising from use of Frisber is limited to the amount paid by you in the three (3) months preceding the claim. Gaviso is not liable for business losses, reputational damage, or indirect or incidental damages.

6.4 Indemnification. You agree to indemnify and hold Gaviso harmless against any claim, liability, or legal action arising from the content, accuracy, or legality of your listing or conduct on the platform.
